Please read these Terms of Service ("Terms") carefully before using the Mediqrate application. By creating an account or using Mediqrate, you agree to be bound by these Terms. If you do not agree, do not use the app.
Mediqrate is operated by Yogesh Pawar (operating as Mediqrate), located at Rossland Ave, Nepean, ON K2G 2K8, Canada ("Mediqrate," "we," "us," or "our").
These Terms apply to all users of the Mediqrate mobile application and website (collectively, the "Service"), regardless of whether you create an account or use the app as a guest.

Mediqrate is a health information and tracking tool — it is not a medical device, not a licensed medical service, and not a substitute for professional medical advice.
Vita (our AI assistant) and all AI-powered features in Mediqrate provide general health information based on data you enter. This information:

If you are between 13 and 18 years old, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
You may use many features of Mediqrate without creating an account. Data collected while using the app as a guest is stored only on your device.
When you create an account, you agree to:
You are responsible for all activity that occurs under your account. Mediqrate is not liable for any loss or damage arising from unauthorized use of your account where you failed to keep your credentials secure.
Mediqrate offers a free tier with limited AI scan usage per month. The specific limits are displayed within the app and may change with reasonable notice.
Mediqrate Pro is a paid subscription that unlocks unlimited AI scans, AI chat, and additional features. Pricing is displayed within the app at the time of purchase.
New Pro subscribers receive a 7-day free trial. Your payment method will be charged at the end of the trial period unless you cancel before the trial ends.

Cancellation takes effect at the end of your current billing period. We do not provide partial refunds for unused time.
Refund requests are handled by Apple or Google under their respective refund policies. We do not process refunds directly. If you believe you have been charged in error, contact support@mediqrate.com.
We may change subscription prices with at least 30 days' advance notice. Continued use after the price change constitutes acceptance of the new price.
Violation of these rules may result in immediate account termination without refund.
By posting in the Mediqrate community, you agree that your content is truthful, does not constitute medical advice directed at specific individuals, and does not contain offensive, hateful, or discriminatory material. We reserve the right to remove any content that violates these guidelines.
Mediqrate, including its design, AI models, software, and branding, is owned by us and protected by applicable intellectual property laws.
You retain ownership of all health data you enter into Mediqrate. By entering your data, you grant us a limited license to store and process it solely to provide the Service to you.
The AI features in Mediqrate (Vita, medicine scanning, food scanning, lab report analysis) generate outputs based on pattern recognition and general health information. These outputs are informational only and may contain errors or inaccuracies. Always verify AI outputs with a qualified healthcare professional.
Medicine identification results are for informational purposes only. Never take, modify, or stop taking medications based solely on Mediqrate's output.
You acknowledge that lab report analyses are stored only on your device and that Mediqrate cannot recover this data if your device is lost, reset, or if you uninstall the app. Mediqrate is a personal tracking tool and not an official medical record.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY AI OUTPUT WILL BE ACCURATE.
MEDIQRATE IS NOT A LICENSED MEDICAL PROVIDER. WE ARE NOT LIABLE FOR ANY HEALTH DECISIONS YOU MAKE BASED ON INFORMATION PROVIDED BY THE SERVICE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MEDIQRATE'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
Nothing in these Terms limits any rights you may have under applicable Canadian, Indian, or EU consumer protection legislation.
You agree to defend, indemnify, and hold harmless Mediqrate, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service in violation of these Terms, or any health decision you make based on Service outputs.
Mediqrate integrates with Supabase (database), Google (AI processing), Apple (payments), and Google Play (payments). Your use of these services through Mediqrate is subject to their respective terms and privacy policies.
You may delete your account at any time through Profile → Privacy & Data → Delete All My Data. We may suspend or terminate your account immediately if you violate these Terms. Upon termination, we will delete your personal data within 30 days in accordance with our Privacy Policy, except where retention is required by law.
These Terms are governed by the laws of the Province of Ontario, Canada. If informal resolution at support@mediqrate.com fails, disputes shall be resolved by binding arbitration under the ADR Institute of Canada, with proceedings conducted in English in Nepean, Ontario. For users in India, disputes are governed by the laws of India.
When we make material changes, we will notify you via push notification and in-app notice at least 30 days before the changes take effect. Continued use of Mediqrate after changes take effect constitutes your acceptance of the updated Terms.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mediqrate. If any provision is found unenforceable, it will be modified to the minimum extent necessary. These Terms are written in English; in the event of translation, the English version prevails.
